RESOLUTION

A RESOLUTION OF THE TRUSTEES OF THE ENID PUBLIC TRANSPORTATION AUTHORITY (EPTA) ADOPTING REVISIONS TO THE EPTA AGENCY SAFETY PLAN AS RECOMMENDED BY THE OKLAHOMA DEPARTMENT OF TRANSPORTATION (ODOT).

WHEREAS, at the August 5, 2025 meeting, the Trustees of the EPTA adopted the EPTA Agency Safety Plan and authorized City staff to submit the plan to ODOT for review and approval, in accordance with Federal Transit Administration (FTA) requirements under 49 CFR Part 673; and

WHEREAS, ODOT has completed its review of the EPTA Agency Safety Plan and has provided a revised version incorporating recommended updates and clarifications to ensure consistency with the ODOT Agency Safety Plan and current FTA guidance; and

WHEREAS, the proposed revisions remove references to FTA Section 5310 funding, clarify that the plan will be reviewed annually, expand the description of how the Safety Policy Statement will be distributed through employee orientation materials, monthly safety updates, and workplace postings, and refine Safety Committee procedures to emphasize quarterly meetings, agenda preparation, and posting of minutes for staff review; and

WHEREAS, additional updates to formatting, terminology, and references further align the EPTA Agency Safety Plan with ODOT standards and enhance overall safety management practices.

NOW, THEREFORE, BE IT RESOLVED by the Chairman and Board of Trustees of the Enid Public Transportation Authority, as follows:

That the Trustees hereby adopt the revised Enid Public Transportation Authority Agency Safety Plan, as reviewed and recommended by the Oklahoma Department of Transportation, and that City staff are authorized to submit the adopted plan to the Oklahoma Department of Transportation for final acknowledgment.

RESOLUTION

A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO LEVY A JUDGMENT OF THE WORKERS COMPENSATION COMMISSION OF THE STATE OF OKLAHOMA ENTERED IN FAVOR OF MICHAEL D. WILLIAMS, AND AGAINST THE CITY OF ENID IN THE AMOUNT OF TWENTY EIGHT THOUSAND FOUR HUNDRED TWENTY DOLLARS ($28,420.00); PROVIDING THAT THIS JUDGMENT WILL BE LEVIED PURSUANT TO 62 OKLA. STAT. §§ 365.1-365.6 AND TITLE 2, CHAPTER 3, SECTION 2-3-2D OF THE ENID MUNICIPAL CODE, 2014; APPROVING AN AGREEMENT WITH THE ENID MUNICIPAL AUTHORITY TO PAY THE JUDGEMENT IN EXCHANGE FOR THE CITY’S PROMISE TO REPAY SUCH JUDGMENT FROM COLLECTED TAX LEVIES;

RESOLUTION

WHEREAS, Michael D. Williams suffered a work-related injury to his neck on June 21, 2023, during the course of his employment; and,

WHEREAS, This matter was adjudicated before the Workers’ Compensation Commission of the State of Oklahoma on November 7, 2025 with the Court entering an Order awarding Michael D. Williams twenty eight thousand four hundred twenty dollars ($28,420.00); and,

WHEREAS, the Mayor and Board of Commissioners deem it in the best interest of the City of Enid to take the actions as provided for in this Resolution.

NOW, THEREFORE, be it resolved by the Mayor and Board of Commissioners of the City of Enid, that:

1. This judgment shall be levied as provided by 62 O.S. §§ 365.1 - 365.6 and Title 2, Chapter 3, Section 2-3-2D of the Enid Municipal Code, 2014; and be paid as follows:

A. Payment on June 15, 2027, of one-third (1/3) of the principal amount together with statutory interest, if any, accrued to date;

B. Payment on June 15, 2028, of one-third (1/3) of the principal amount with statutory interest, if any, accrued since first payment;

C. Payment on June 15, 2029, of the balance of the principal and statutory interest due, if any.

2. That Michael D. Williams has assigned his judgment to the Enid Municipal Authority (EMA); the EMA will pay Williams; and the EMA, pursuant to an Acknowledgment of Judgment, is willing to accept payment of the judgment from the City of Enid from collected tax levies, is approved herein.

3. The City of Enid approves the Agreement with the EMA.

RESOLUTION

A RESOLUTION AUTHORIZING THE CITY’S SELECTION OF AN ENGINEERING CONSULTANT FROM THE OKLAHOMA DEPARTMENT OF TRANSPORTATION’S (ODOT) PREQUALIFIED CONSULTING FIRMS TO PERFORM BRIDGE INSPECTIONS FROM APRIL 1, 2026 TO MARCH 31, 2028 FOR COMPLIANCE WITH NATIONAL BRIDGE INSPECTION STANDARDS.

WHEREAS, the City of Enid has the responsibility of bridge maintenance and safety inspections and,

WHEREAS, the City of Enid has the following options:

1. Select one of ODOT’s prequalified engineering firms.

2. Elect to do bridge safety inspections with your own forces using inspection teams and an oversight engineer fully qualified as mandated by the NBIS (National Bridge Inspection Standards).

3. Use the same consultant as Garfield County.

4. Let ODOT make your selection.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Board of Commissioners of the City of Enid, Oklahoma that it is their desire to select:
